EPA Proposes Updated “Waters of the United States” Definition

EPA is proposing to amend the definition of “Waters of the United States” in light of the U.S. Supreme Court’s 2023 decision in Sackett v. EPA. Specifically, EPA is proposing to remove the interstate waters category as an independent basis for determining jurisdiction; add regulatory definitions for “relatively permanent,” “continuous surface connection,” “tributary,” “ditch,” “prior converted cropland,” and “waste treatment system;” revise the exclusions for waste treatment systems, prior converted cropland, and ditches; and add an exclusion for groundwater.

The Last Wave: EPA and Army Corps Seek to Conform WOTUS Definition to Sackett

The U.S. Environmental Protection Agency (EPA) and U.S. Army Corps of Engineers on Nov. 17, 2025, provided a pre-publication version of their proposed rule intended to provide greater regulatory certainty by clarifying the definition of “waters of the United States” (WOTUS).
The proposed rule aims to align with the U.S. Supreme Court’s decision in Sackett v. EPA, which narrowed the scope of federal jurisdiction.

Conditions on Trichloroethylene Exemptions Postponed Again
November 18, 2025
EPA is extending the postponement of certain provisions for the regulation of trichloroethylene (TCE) under TSCA for an additional 90 days, until February 17, 2026. This postponement is specifically for conditions that must be met to qualify for exemption from the prohibition on use of TCE originally finalized in a December 17, 2024 final rule (89 FR 102568).

EPA Amends EPCRA Hazardous Chemical Inventory Reporting Requirements

EPA is changing its hazard categories for reporting under EPCRA sections 311 and 312 (hazardous chemical inventory reporting) to conform to changes made by OSHA in 2024 for how chemical hazards must be reported on Safety Data Sheets (SDS).
